The WEDOITFORTHELOVEOFMUSIC.COM (also accessible at WDFLM.COM) website and service are owned and operated by WEDOITFORTHELOVEOFMUSIC.COM L.L.C. (“WDFLM” or “we”).  At WDFLM, we understand that you value your privacy, and we want to help make your experience with the Service satisfying and safe.  This “Privacy Policy” advises you about the information that WDFLM collects from you when you visit or use the Service, and how we use, share, and protect that information.  Since WDFLM is firmly committed to maintaining the confidentiality of your personal information, we urge you to read and fully comprehend, and to make a practice of staying abreast of any and all updates to, our Privacy Policy.  (Capitalized terms not otherwise defined in this Privacy Policy shall have the meaning ascribed to them in the Terms of Service or other relevant Policies pertaining to the Service.)

CONSISTENT WITH THE FEDERAL CHILDREN'S ONLINE PRIVACY PROTECTION ACT OF 1998 (COPPA), WE WILL NEVER KNOWINGLY REQUEST PII FROM ANYONE UNDER THE AGE OF 13 WITHOUT REQUIRING PARENTAL CONSENT.  ANY PERSON WHO PROVIDES HIS OR HER PII TO US THROUGH THE SERVICE SERVICES REPRESENTS THAT HE OR SHE IS 13 YEARS OF AGE OR OLDER.

DISCLOSURE OF PII

The sharing practices described below only apply to information we collect from you on the Service—specifically for website-related purposes (e.g., User Profile, sign-in to vote, e-newsletters, online store purchases, periodic online customer surveys, User queries, etc.).

We may share your website-related information (including your personal contact information) as set forth below:

PROFILE DATA AND OTHER PII AVAILABLE TO OTHER USERS 

Some features on the Service may allow you to post PII that is available to other Users of the service.  For example, if you provide a description of a product, or post a vote, rating, or review regarding a third party or any products, that information will be made available to other Users who view that listing.  (Additionally, any information that you make available in your profile will be available to other Users.)  You include PII in any postings to the Service, and make PII available in your User Profile, at your sole risk.  We cannot control the actions of other Users with whom you may choose to share PII, whether you share it on the Service or by other means (e.g., e-mail, telephone, SMS (text messages), IM, Skype, and physical address).  Additionally, even after information posted on the Service is removed, caching and archiving services may have saved that information, and other Users or third parties may have copied or stored the information available on the Service.  We cannot, and do not, warrant or guarantee that any PII that you provide on and in connection with the Service will not be accessed, viewed, used, or misappropriated by unauthorized persons.

THIRD-PARTY SITES AND SERVICES

The Service may contain links to third-party sites and services.  Any links to third-party sites or services are provided for your convenience only, and we do not have control over the content or privacy and security practices and policies of such third-parties or other sites.  Any PII that you provide to our data destination partners or to other third-parties is subject to those third-parties’ privacy practices and policies, not this Policy.  We encourage you to learn about their privacy and security practices and policies before furnishing any PII to them.  

Below, we strongly suggest that you familiarize yourself with some of the most prominent third-party services that are incorporated into the Service.

  1. PayPal – We use PayPal.com (the “Payment Site”), to handle the payment transactions effectuated via the Service.  If you wish to make a purchase through the Service, you will be directed to certain webpages that are hosted by the Payment Site (or its service providers) and not by us (such pages, the “Payment Site Webpages”).  Any PII that you provide through the Payment Site Webpages will be collected directly by the Payment Site rather than by us, and will be subject to the Payment Site’s privacy policy (located at https://www.paypal.com/us/webapps/mpp/ua/privacy-full) rather than this Policy.  We have no control over, and shall not be responsible for, the Payment Site’s use of any information collected through the Payment Site Webpages.  FOR EMPHASIS, CLARITY AND THE AVOIDANCE OF DOUBT, PLEASE NOTE THAT THIS POLICY DOES NOT ADDRESS (I) THE COLLECTION AND USE OF ANY INFORMATION BY OR THROUGH THE PAYMENT SITE WEBPAGES, OR (II) THE PRIVACY OR INFORMATION PRACTICES OF THE PAYMENT SITE.

  1. Social Login – If you choose to register or login to the Service through a Social Networking Service, we will ask you for your permission to access your data on the Social Networking Service to facilitate your use of the Service.  In addition, we may use this data for several purposes on the Service, including:

demographic information of our users.

You may disconnect from a linked Social Networking Service at any time by visiting the “My Account” section of the Service.

We will not share any information about you collected on the Service with a linked Social Networking Service without your approval.  This means that we will not post anything to your Facebook wall, Google account, or Twitter feed unless you give us specific permission to do so, and we will not contact your friends or followers at any time.  We do not store or utilize the names of your friends or followers even if they are passed to us by a social sign-on service in the initial registration process.

Social Networking Services provide varying levels of control over the extent to which content or information you submit to the Service is also made public and shared on linked Social Networking Services.  When you use a Social Networking Service to log into the Service:

INTERNATIONAL VISITORS AND CUSTOMERS

THIS SERVICE IS HOSTED IN THE UNITED STATES, AND WE PROVIDE OUR OTHER SERVICES FROM THE UNITED STATES.  IF YOU USE OUR SERVICES FROM THE EUROPEAN UNION OR OTHER REGIONS WITH LAWS GOVERNING DATA COLLECTION AND USE THAT MAY DIFFER FROM U.S. LAW, PLEASE NOTE THAT YOU ARE TRANSFERRING YOUR PII TO THE UNITED STATES.  THE UNITED STATES DOES NOT HAVE THE SAME DATA PROTECTION LAWS AS THE EU AND SOME OTHER REGIONS.  BY PROVIDING YOUR PII, YOU CONSENT TO THE TRANSFER OF YOUR PII TO THE UNITED STATES AND THE USE OF YOUR PII, IN ACCORDANCE WITH THIS POLICY.

SECURING YOUR INFORMATION

We use a variety of industry standard methods to keep the information you give us online confidential and secure.  These measures include (among other things) the use of industry-standard encryption to protect sensitive information and activities, storage of your information on firewall-protected servers, and limiting access to your information to only those WDFLM officers, employees, and third-party administrators (agents or contractors) who have (a) “bona fide” need to know it to fulfill their purpose, (b) been trained in the proper handling of personally identifiable and sensitive customer information, and (c) expressly agreed to preserve the confidentiality of such information.

For specificity, you should note that, during any e-commerce transactions (namely checkout processes) with WDFLM, you will receive an SSL (Secure Socket Layer) certificate with a minimum 256-bit encryption.  Please be aware that e-mail communications are generally unencrypted; thus, we urge you not to transmit any credit card data via e-mail, as it is widely regarded as an unsecure means of electronic transmission.  (WE WILL NEVER ASK FOR YOUR SENSITIVE INFORMATION (INCLUDING, WITHOUT LIMITATION, CREDIT CARD DATA) VIA EMAIL.)

At all times during WDFLM’s custody of your PII, we will employ effective physical, technical, and procedural safeguards to help secure your Personally Information and to minimize any potentially adverse conditions pertaining to the same.  Further, any WDFLM employees or contractors who misuse or misappropriate any user information, or violate this Privacy Policy in any manner, shall be subject to immediate disciplinary action, up to and including termination, and may also be subject to harsh criminal and civil penalties.

INFORMATION RETENTION AND DISPOSAL

We retain PII for as long as we have a business need for it, or as applicable laws or regulations or government orders require us to retain it.

PRIVACY POLICY CHANGES AND UPDATES

If WDIFLM revises the manner in which we handle your PII, we will post such changes to this Privacy Policy.  For all material changes (i.e., substantially new practices you would not expect from us or that we did not previously disclose in this Policy), we may elect to notify you via e-mail (if available to us through the Service) or by way of a conspicuous and prominent “Privacy Policy Update” alert on the Service (such as through a notice on the home page of the Service).

UPDATES TO USER PROFILES; OPTING-OUT FROM CERTAIN FEATURES OR SERVICES

If you created a User Profile (or an online account, as applicable) on the Service, you can always access and update the same (including the name, contact information, and password associated with your User Profile or online account) by logging in to your User Profile (or online account) and clicking on “Profile” or other applicable links.  

If you ever receive our e-newsletter or other electronic marketing communications, you can always opt-out from receiving such communications by clicking on the “Unsubscribe” link provided at the bottom of each such email communication, or by contacting WDFLM’s Webmaster, as provided herein.
